Unauthorized Use and resell of my product on Codecanyon

This is a serious matter regarding the unauthorized sale of my UI design on this platform. I am an Author on Envato but Recently, I discovered that someone is selling my fintech UI design without my permission. Not only that, but they are also providing the source files, which were created by me and my colleagues, Saloni.

Here are the details:

  1. Product Name: PayYou Digital Wallet
  2. Unauthorized Seller’s Products:
  1. Issue:
  • The seller is using my UI design and distributing with his end product without proper authorization.
  • They are misleading buyers by using my UI name.
  • This unauthorized sale undermines the hard work and creativity invested in the original design.
  1. Request:
  • I kindly request that you take immediate action to remove both products from the platform.
  1. More Info:
  • Our fintech UI design was featured on multiple platforms, and we take great pride in our work.
  • The unauthorized seller’s actions not only harm our reputation but also violate intellectual property rights.

You’re selling the design to be used in a project, therefor I’m not sure if you could claim any rights of the file that has been already sold for distribute/re-sell as I couldn’t see any warning or license terms that the project is not for resell.

On top of that, if the “name” is not registered/copyrighted by you, you cannot claim the rights of the usage for the name.

"What you CANNOT do:

Re-distribute the Item as a stock image or it’s source files, regardless of any modifications, under any circumstances. In other words, you cannot replicate or make modifications to the item and sell it on UI8 or other marketplaces as your own, even if the source files are not included.
Make a theme, template, or derivative work of any product to sell on any marketplace.
Resell or otherwise distribute downloaded assets on any marketplace including UI8, as well as via private channels and bots under any circumstances not allowed.
Note: Violation of these terms will be pursued to the fullest extent of the law."

Follow the link I have shared earlier to submit DMCA takedown but if it’s sold at here, there’s nothing you can do as there’s no terms/license details…

Adding the “terms” after the item sold is not gonna support your issue, by the way. You cannot just update the terms
