Question to Envato Team about Generative AI images from our product previews offered for download.

My question may be useful not only for me - therefore, instead of creating a ticket, I will ask it on the forum here. It is about using AI generated photos and graphics in the previews of our projects.

My question is for @KingDog and @BenLeong (and any other Envato Team member who can answer to this question).

Currently we can use AI generated photos and graphics in the preview of our projects (I am talking about Midjourney - which I use) if we have all rights to do this → if we generated these photos and graphics during a purchased subscription on Midjourney we have all rights to do this (this is clearly stated in Midjourney terms and conditions - including reselling them but on Envato we can use them only int previews without adding them to our zip files - that’s clear).

My question:

If I use Midjourney generated graphics in the preview of my project (for example) a magazine ->> can I pack these used in preview graphics into a zip and place it, for example, on a Google server and place a link to this package in the PDF help file so that everyone who bought my project could download such a package with graphics for free? ->> I want to know if I can do this and give such information in the description of my product that these graphics can be downloaded for free from the Google link.

This is just a question - not an expectation. I would like you to consult this within Envato and if it turns out that I can do this, to inform the Envato Review Team so that there are no misunderstandings during item review process :slight_smile:

Also if this is not allowed → no problem, just let me know here and we have clear situation.

Time for an update - I received a response from Envato Support (thank you Sophie). Here is the response:

To answer your question, I’d like to quote your AI-generated content policy,

AI-generated content can be used for preview purposes only, and must not be included in the download file.
Please note that just as with any other assets used within your item preview, it remains your responsibility to ensure that you have the correct commercial license to use the asset within the item preview. For more information please see What assets can I use in my items?

  • As an example, you can use AI tools to generate an illustration and use it as a preview image in your blog template, provided the AI license allows you to do this. The image cannot be included in the download file.
  • If your item includes a demo content import, AI-generated content can be imported directly from your server, as long as it is not included in the item zip file .

As per our AI policy, it is permitted under the following conditions:

  • You can let users know demo content is available, however, it is important to not include direct links to demo content in the item description or item documentation.
  • You are responsible for obtaining proper licenses for AI graphics used in previews and demos.
  • Clearly state whether the content is available for use in the final product or for display only.

So basically I can tell my customers something like: “Hey, you can get all images used in previews for free” - and that’s it, no links allowed in description or help. I think it’s better not to say anything in this case.
