Use of register_post_type in WordPress themes

Hi,

We are developing a WordPress theme and would like to put on ThemeForest. But the theme has custom post types and uses register_post_type() function. This gives an error in the Theme Check plugin.
Also, the submission guidelines mention that some exceptions are allowed. So I was a little confused as does this point come under exception or do we need to remove it ?
