We would like to remind you of the importance of complying with the Envato Trademark Usage Guidelines. We’ve highlighted a couple of the key features of our guidelines, with some examples below.
What is a Trademark?
A trademark is not just a logo. A trademark can be a distinctive word, phrase, letter, number, sound, smell, shape, logo, picture, aspect of packaging (or a combination of these), which is used by someone to identify that it’s goods or services originate from a particular source or to distinguish their goods or services from someone else. Registered trademarks usually have the symbol ® or TM immediately after the mark.
How is a Trademark Infringed?
A trademark owner, such as The Fédération Internationale de Football Association (FIFA) or Nestle for example, may have the right to stop others from using their trademarks, or any deceptively similar trademark, on or in connection with goods or services that are identical or closely related to the goods or services of the trademark owner.
It is important to understand the different situations and circumstances in which a registered and unregistered trademark is protected as the unauthorized use of trademarks, logos and real-world products in your items constitutes as trademark infringement and can result in legal consequences for authors.
